1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Cheez mobile application ("App," "Service," "we," "us," or "our"). By accessing or using the App, you agree to comply with these Terms. If you do not agree, do not use the App.

2. Description of Service

Cheez is an AI-powered selfie camera application that provides:

• Real-time face detection and quality analysis
• Automatic photo capture based on quality thresholds
• Quality scoring and improvement tracking
• Photography tutorials and educational content
• Photo gallery and sharing functionality

3. User Accounts

3.1 Account Creation

You may create an account using:

• Email and password
• Google Sign-In
• Apple Sign-In

You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

3.2 Account Requirements

You must:

• Be at least 13 years old to create an account
• Provide accurate and complete information
• Keep your account information up to date
• Not share your account with others
• Notify us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Subscription Plans

4.1 Free Tier

Free users receive:

• 5 selfies per day
• Option to watch ads for additional selfies
• All core features (face detection, quality scoring, tutorials)

4.2 Cheez Pro Subscription

Pro subscribers receive:

• Unlimited daily selfies
• No ads
• Support for continued development

Pricing:

• Weekly Plan: $1.99/week with 7-day free trial
• Yearly Plan: $39.99/year with 7-day free trial

4.3 Free Trial

New subscribers receive a 7-day free trial. You can cancel anytime during the trial period without being charged. If you don't cancel before the trial ends, you will be automatically charged for the subscription.

4.4 Billing and Renewal

• Subscriptions are billed through your Apple ID account
• Payment is charged at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel subscriptions in your Apple ID Account Settings

4.5 Price Changes

We may change subscription prices at any time. Price changes will be communicated 30 days in advance and will apply to subsequent billing cycles. Continuing your subscription after a price change constitutes acceptance of the new price.

4.6 Cancellation

To cancel your subscription:

1. Open Settings on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select Cheez
5. Tap "Cancel Subscription"

Cancellation takes effect at the end of the current billing period. You will retain Pro access until then.

5. Refund Policy

All purchases are processed through Apple's App Store and are subject to Apple's refund policies. We do not have direct control over refunds.

To request a refund:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Select Cheez purchase
4. Click "Report a Problem" and follow the instructions

Refund requests are typically reviewed within 48 hours. Apple's decision is final.

6. Acceptable Use

6.1 Permitted Use

You may use Cheez for personal, non-commercial purposes to capture and edit your own selfies.

6.2 Prohibited Activities

You may NOT:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent daily selfie limits or other restrictions
• Use automated systems (bots, scripts) to access the App
• Interfere with or disrupt the App's functionality
• Upload malicious code, viruses, or harmful content
• Violate others' privacy, rights, or dignity
• Impersonate others or misrepresent your identity
• Resell, redistribute, or commercially exploit the App

7. Content and Intellectual Property

7.1 Your Content

You retain all rights to photos you capture using Cheez. We do not claim ownership of your photos. You are solely responsible for your content and any consequences of sharing it.

7.2 Our Intellectual Property

The App, including its code, design, algorithms, AI models, logos, and content, is owned by Cheez and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or redistribute any part of the App without our express written permission.

7.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes in accordance with these Terms.

8. Third-Party Services

The App integrates with third-party services:

• Firebase: Authentication and cloud storage (Privacy Policy)
• Google AdMob: Advertising (Privacy Policy)
• Apple App Store: Payments and subscriptions (Privacy Policy)

We are not responsible for third-party services' terms, policies, or practices. Your use of these services is subject to their own terms.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

Cheez is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Guarantees

We do not guarantee that:

• The App will be error-free, uninterrupted, or secure
• Face detection will work in all lighting conditions
• Quality scores reflect objective photographic quality
• Auto-capture will function perfectly in all scenarios

9.3 Limitation of Liability

To the maximum extent permitted by law, Cheez and its affiliates shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Lost profits, data, or opportunities
• Damages resulting from use or inability to use the App
• Third-party actions or content

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $50, whichever is greater.

9.4 Device Responsibility

You are responsible for:

• Ensuring device compatibility (iOS 16.6 or later)
• Backing up your photos
• Protecting your device from theft or damage
• Data charges from your mobile carrier

10. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the App, you consent to our privacy practices.

11. Updates and Changes

11.1 App Updates

We may release updates to add features, fix bugs, or improve performance. Some updates may be required for continued use. You are responsible for keeping the App updated.

11.2 Changes to Terms

We may modify these Terms at any time. When we do:

• We will update the "Last Updated" date
• We will notify you through the App or via email for material changes
• Your continued use after changes constitutes acceptance

If you don't agree to the updated Terms, you must stop using the App and may cancel your subscription.

12. Termination

12.1 By You

You may stop using the App at any time by:

• Deleting the App from your device
• Deleting your account in Settings
• Canceling your subscription (if applicable)

12.2 By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the service or other users

Termination does not entitle you to a refund unless required by law.

13. Dispute Resolution

13.1 Informal Resolution

If you have a dispute, please contact us at support@cheezapp.top first. We will attempt to resolve the issue informally within 30 days.

13.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. You waive your right to a jury trial or class action lawsuit.

13.3 Governing Law

These Terms are governed by the laws of the United States and the state where Cheez is operated, without regard to conflict of law principles.

14. Miscellaneous

14.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Cheez regarding the App.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not transfer your rights under these Terms. We may assign our rights to any affiliate or successor.
